1. INTRODUCCIÓN Y ACEPTACIÓN

La aplicación Q24 (en adelante, “la Aplicación”) es propiedad y está operada por el responsable [Nombre Legal], con domicilio en [Dirección]. Al utilizar Q24 (app móvil, dispositivos asociados o soluciones vinculadas), usted acepta y se compromete a cumplir estos Términos de Uso, junto con nuestra Política de Privacidad. Si no está de acuerdo, no utilice la aplicación. Para usar Q24, debe tener al menos 18 años.

2. NATURALEZA DEL SERVICIO Y LÍMITE DE GARANTÍA (ESCUDO LEGAL)

Q24 es un servicio y software complementario diseñado para la seguridad personal. El Usuario reconoce y acepta expresamente que Q24 NO SUSTITUYE a los servicios de emergencia gubernamentales (911, 112, Policía, Bomberos o Servicios Médicos).

La funcionalidad de Q24 incluye (sin limitarse a): Localización en tiempo real, Grabación de audio/video y Notificaciones a contactos de emergencia. La Empresa no tiene potestad policial, no garantiza tiempos de respuesta de terceros, ni asegura la integridad física del Usuario.

3. LIMITACIONES TÉCNICAS Y EXENCIÓN DE RESPONSABILIDAD

Q24 se proporciona “tal cual”, sin garantías de ningún tipo. El Usuario comprende que la eficacia del servicio está sujeta a la disponibilidad y correcto funcionamiento de redes de terceros. La Empresa NO será responsable por daños, pérdidas o perjuicios directos o consecuenciales derivados de:

• Alertas no enviadas, recibidas con retraso o ubicaciones inexactas causadas por falta de cobertura de red, fallos de GPS o batería insuficiente.
• Fuerza mayor, caso fortuito, o interrupciones de servicios externos (Internet, ISPs).
• La omisión por parte del Usuario de contactar a las autoridades locales por los medios tradicionales.

4. PAGOS, SUSCRIPCIONES Y CANALES DE VENTA

Q24 ofrece servicios de suscripción ("Premium"). Los precios y condiciones varían según el canal:

• Compras en Tienda (In-App Purchase): Adquiridas a través de Google Play o Apple App Store. Estas se rigen por las políticas de pago, renovación y reembolso exclusivas de Google/Apple. La Empresa no tiene la facultad de gestionar cancelaciones o reembolsos de estas suscripciones.
• Compras en Web: Adquiridas directamente en el sitio web de Q24. Estas se rigen por los términos y pasarelas de pago de terceros.

El Usuario se compromete a no utilizar mecanismos dentro de la Aplicación para eludir el pago de tarifas correspondientes a la Empresa.

5. LICENCIA DE USO

Se le concede una licencia limitada, no exclusiva, revocable y no transferible para usar Q24, conforme a lo aquí establecido. La aplicación se licencia, no se vende.

6. TERMINACIÓN

El usuario puede solicitar la terminación de su cuenta. El Responsable eliminará la información conforme a su Política de Privacidad. El Responsable podrá suspender o eliminar cuentas en caso de incumplimiento grave de estos Términos, incluyendo el uso fraudulento o la generación intencional de falsas alarmas.

7. CONDUCTA DEL USUARIO Y USO INDEBIDO

El usuario se compromete a NO utilizar Q24 para actividades ilegales, envío de virus, amenazas o ingeniería inversa. El Usuario será el único responsable legal y económico ante cualquier sanción, multa o demanda derivada del uso negligente o malintencionado de la alerta (falsas alarmas) que movilice recursos públicos o privados.

8. INFORMACIÓN Y GARANTÍAS

El usuario garantiza que la información proporcionada (incluyendo la de sus contactos de emergencia) es veraz y que cuenta con la autorización necesaria para transmitir dichos datos.

9. CÓDIGO DE SEGURIDAD

El código de seguridad generado por Q24 para verificar la identidad es personal e intransferible.

10. LEY APLICABLE Y JURISDICCIÓN

Todas las cuestiones legales derivadas del uso de Q24 se regirán por las leyes locales aplicables. El usuario acepta la jurisdicción exclusiva de los tribunales correspondientes.

1. INTRODUCTION AND ACCEPTANCE

The Q24 application (hereinafter, "the App") is owned and operated by [Legal Name], located at [Address]. By using Q24 (mobile app, associated devices, or linked solutions), you agree to comply with these Terms of Use, along with our Privacy Policy. If you do not agree, do not use the application. To use Q24, you must be at least 18 years old.

2. NATURE OF SERVICE AND LIMITATION OF WARRANTY

Q24 is a complementary personal safety service and software. The User expressly acknowledges and agrees that Q24 DOES NOT REPLACE government emergency services (911, 112, Police, Fire, or Medical Services).

Q24 functionality includes (but is not limited to): Real-time location tracking, Audio/Video recording, and Emergency contact notifications. The Company holds no police authority, does not guarantee third-party response times, and does not ensure the User's physical safety.

3. TECHNICAL LIMITATIONS AND DISCLAIMER

Q24 is provided "as is," without warranties of any kind. The User understands that service effectiveness is subject to the availability and proper functioning of third-party networks. The Company shall NOT be liable for direct or consequential damages, losses, or injuries arising from:

• Alerts not sent, received with delay, or inaccurate locations caused by lack of network coverage, GPS failures, or insufficient battery.
• Force majeure, acts of God, or interruptions of external services (Internet, ISPs).
• The User's failure to contact local authorities via traditional means.

4. PAYMENTS, SUBSCRIPTIONS, AND SALES CHANNELS

Q24 offers subscription services ("Premium"). Prices and conditions vary by channel:

• Store Purchases (In-App Purchase): Acquired through Google Play or Apple App Store. These are governed by Google/Apple's exclusive payment, renewal, and refund policies. The Company does not have the authority to manage cancellations or refunds for these subscriptions.
• Web Purchases: Acquired directly on the Q24 website. These are governed by third-party terms and payment gateways.

The User agrees not to use mechanisms within the App to evade payment of fees owed to the Company.

5. LICENSE TO USE

You are granted a limited, non-exclusive, revocable, non-transferable license to use Q24, as established herein. The application is licensed, not sold.

6. TERMINATION

The user may request account termination. The Data Controller will delete information in accordance with its Privacy Policy. The Controller may suspend or delete accounts in case of serious breach of these Terms, including fraudulent use or intentional generation of false alarms.

7. USER CONDUCT AND MISUSE

The user agrees NOT to use Q24 for illegal activities, sending viruses, threats, or reverse engineering. The User shall be solely legally and financially responsible for any sanction, fine, or lawsuit derived from negligent or malicious use of the alert (false alarms) that mobilizes public or private resources.

8. INFORMATION AND WARRANTIES

The user warrants that the provided information (including that of their emergency contacts) is truthful and that they have the necessary authorization to transmit such data.

9. SECURITY CODE

The security code generated by Q24 to verify identity is personal and non-transferable.

10. APPLICABLE LAW AND JURISDICTION

All legal matters arising from the use of Q24 shall be governed by applicable local laws. The user accepts the exclusive jurisdiction of the corresponding courts.
